All information, including without limitation text, graphics, software, trademarks, logos, service marks and all other materials including the HTML, XML, CGI and any other code and script in any format used to implement our Booking Engine or Website (“Content”), are our property. You may not copy, reproduce, republish, upload, post, transmit, distribute, sell, transfer or modify any of the information or materials found on the Site, except that You may print portions of this Site solely for your personal, non-commercial use of such material as a shopping resource.

2. LIABILITY DISCLAIMER AND LIMITS
HOTELSPEEDY MAKES NO WARRANTY OF ANY KIND REGARDING THIS SITE AND/OR ANY CONTENT, DATA, MATERIALS, INFORMATION, PRODUCTS OR SERVICES PROVIDED THEREON, ALL OF WHICH ARE PROVIDED ON AN "AS IS" BASIS. HOTELSPEEDY EXPRESSLY DISCLAIMS ANY REPRESENTATION OR WARRANTY THAT THE SITE WILL BE ERROR-FREE, SECURE OR UNINTERRUPTED. Without limiting the above, no warranty or guarantee is made (i) regarding the acceptance of any reservation placed, (ii) that you will receive the lowest available price for goods and/or services available through this Site, (iii) regarding the availability of products and/or services through this Site or, where applicable, through any Affiliate, (iv) that use of this Site and all software, products or services associated with this Site will be error free, (v) regarding the results that may be obtained from the use of this Site, (vi) regarding the completeness, accuracy, reliability or quality of any information content, data, service, advice or merchandise provided or available through this Site, or (vii) regarding the performance or non-performance of this Site including, but not limited to, any performance or non-performance in connection with or as a consequence of the passage of time. You expressly agree that the use of this Site is at your sole risk. Hotelspeedy is acting solely as a booking agent for hotels or other travel service providers (collectively, "Travel Suppliers") in selling travel services, or in accepting reservations or bookings for such services to be provided to You. Hotelspeedy does not assume liability for any injury, damage, death, loss, accident or delay due to any fault, act of negligence, omission or default of a Travel Supplier, or by an act of God. Further, no responsibilities are accepted for any damage and/or delay due to sickness, pilferage, labor disputes, machinery breakdown, quarantine, government restraints, weather or other causes. You agree that Hotelspeedy is not responsible for any additional expense, omissions, delays, re-routing or acts of any governmental authority or entity other than Hotelspeedy. The contract of carriage in use by a Travel Supplier, when issued, shall be between the Travel Supplier and the passenger. IN NO EVENT SHALL HOTELSPEEDY, ITS RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES, AFFILIATES, ATTORNEYS OR PROVIDERS (COLLECTIVELY, THE "COVERED PARTIES"), BE LIABLE FOR ANY INJURY, DEATH, LOSS, CLAIM, DAMAGE, ACT OF GOD, ACCIDENT, DELAY, OR ANY SPECIAL, EXEMPLARY, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ANY KIND, WHETHER BASED IN CONTRACT, TORT OR OTHERWISE, WHICH ARISE OUT OF OR ARE IN ANY WAY CONNECTED WITH ANY USE OF THIS SITE OR WITH ANY DELAY OR INABILITY TO USE THIS SITE, OR FOR ANY INFORMATION, SOFTWARE, PRODUCTS OR SERVICES OBTAINED THROUGH THIS SITE, EVEN IF A PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. No responsibility is accepted for any additional expense, omissions, delays, re-routing or acts of any governmental authority. No Covered Party shall be responsible for any Travel Supplier's breach of any warranty including, but not limited to, implied warranties of fitness for a particular purpose or of merchantability, nor shall any Covered Party be responsible for any other wrongdoing of a Travel Supplier (including any liability in tort), as to any products and/or services available through this Site. No Covered Party shall be responsible for any Travel Supplier's failure to comply with these Terms nor for any Travel Supplier's failure to comply with applicable federal, state and local law. HOTELSPEEDY IS NOT RESPONSIBLE OR LIABLE FOR (A) ANY DAMAGES TO OR VIRUSES THAT MAY INFECT YOUR COMPUTER EQUIPMENT OR OTHER PROPERTY AS THE RESULT OF YOUR USE OF THE SITE OR (B) ANY INJURY, LOSS, CLAIM, DAMAGE, OR ANY SPECIAL, EXEMPLARY, PUNITIVE, INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ANY KIND (INCLUDING WITHOUT LIMITATION LOST PROFITS OR LOST SAVINGS), WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY OR OTHERWISE, THAT ARISES OUT OF OR IS IN ANY WAY CONNECTED WITH (I) ANY USE OF THE SITE, (II) ANY FAILURE OR DELAY (INCLUDING WITHOUT LIMITATION THE USE OF OR INABILITY TO USE ANY COMPONENT OF THIS SITE FOR RESERVATIONS OR TICKETING), OR (III) THE PERFORMANCE OR NON PERFORMANCE BY US OR ANY AFFILIATE, EVEN IF WE HAVE BEEN OR AN AFFILIATE HAS BEEN ADVISED OF THE POSSIBILITY OF DAMAGES TO SUCH PARTIES OR ANY OTHER PARTY. It is a violation of law and these Terms to place a reservation in a false name or with an invalid credit card. Fraudulent users will be prosecuted to the fullest extent of the law. You agree not to use any device, software or routine that interferes or attempts to interfere with the normal operation of the Site or take any action that imposes an unreasonable load on our computer equipment. You will not use any robot, spider, other automatic device, or manual process to monitor materials available through our site. You agree not to use the Site for any commercial purposes, including but not limited to, use in connection with or for the benefit of a travel business. You agree that any such use constitutes unfair competition and may cause irreparable injury. If you use this Site to place reservations on behalf of a third party, you must be an authorized representative of that third party, with authority to enter into this Agreement and bind the third party you represent. Your access to all or part of this Site may be terminated or suspended at any time, without notice and for any reason.

4. PRIVACY

By using the Site, you are indicating that you have read and accept the information practices in our Privacy Policy. Hotelspeedy uses the personal information you submit for the purpose of placing your reservation. Hotelspeedy does not sell your personal information to third parties. Hotelspeedy reserves the right to comply with law enforcement requests or requirements, including requests for your personal information, relating to your use of the Site.

This Site may contain links to other sites that Hotelspeedy does not operate or control. Hotelspeedy provides such links for your reference and convenience and is not responsible for the content of these other sites. Hotelspeedy does not endorse the content any third party sites. These links are not an indication of our association with the owners or operators of any of these other sites. You are free to access these other sites, but you do so at your own risk. You agree not to create a link from any site, including any site controlled by You, to our Site.

6. TERMS OF SERVICE
Cancellation Policies. You may cancel or change your reservation, but you will be charged the cancellation or change fee indicated on the reservation order form. In addition, if you do not cancel or change your reservation before the cancellation policy period applicable to the hotel your reserved, which varies by hotel (usually 24 to 72 hours prior to your date of arrival), You will be subject to a charge of one-night's room rate, tax charges and service fees. See the hotel description for the cancellation policy period for each hotel. You agree to pay any cancellation or change fee that You incur. In some cases, we are unable to permit changes to or cancellations of reservations after they are made, generally for stays during holiday periods or special events. You will be notified before the reservation order is completed and your credit card is charged if a reservation is non refundable or non changeable. You agree to abide by the terms and conditions imposed with respect to any completed reservation order for a hotel stay as specified on the reservation order form.
